Seems like you're quoting something here - perhaps a section of the United States Code? Couldn't be bothered to cite which statute you're quoting?

Really? Which one? And when exactly was this government determined by "the Secretary of State . . . [to be] a terrorist government for the purposes of section 4605(j) [1] of title 50, or 2371 of" whichever title you're quoting from?
 
Let's look at the actual statute from which that quote comes -- 22 U.S.C. § 2378. Note that there is no criminal penalty for this if the statute is violated. There might be one in Title 18 of the U.S.C. as that title contains most of the federal criminal statutes.
However, I think that's extremely unlikely as Congress gave the president the authority to make the transfer though by a waiver process that the president has complete control over. This authority is found in subsection (b), which you just happend to leave out. So it would really difficult for a President to violate this section. His lawyers would advise him of the simple waiver process and that would clear any problem.
Finally, even if Biden had violated a criminal statute by Supreme Court rulings a president cannot be arrested and prosecuted while in office. That has to wait until after the president leaves office.
Bottom line here is that the "penalty" for making the transfer would be if the voting public disagreed with it and made that known by voting for someone else for president in 2024.
