What's best for the child with a neglectful mother

A child lives with the father and the mother lives in a different state far away. The mother barely visits or phones the child and sometimes her visit leaves the child in tears from the things that she tells him when they're together. The father now lives with a woman who cares for the child as her own from financial responsibility to emotionally security to the school recognition of her as a positive parental role in the child's life. Since the birth mother lives in a different state and is not around the child often enough to make everyday necessary decision for the child, can the woman who lives with the child and father become the child's legal guardian without asking the birth mother for permission?
 
No. This other woman has no rights and she cannot sidestep the rights of mom and get guardianship without moms permission.
 
Pay someone to tell you want to hear.

Asking the same question on multiple sites will not erase the Mother's rights.
