Thinking of Divorce here in NY.. Help..

I have been married for nine years. No children and in New York. If we decide to divorce, my husband and I would sell our home. My question is if I leave the home during the process of divorce, is it possible that I won't get any money for the home when it is sold? A friend told me that I should get a legal seperation first before I leave the home as the process for divorce is going. I don't want to stay in the same house as him because my job is closer to my parents home and it would be easier for me to move out until the home is sold. Also, I know I would be responsible for the mortgage if I left until it's sold. But am I also responsible for the utility bills as well?

Please help.

In most long-term marriages, the assets/debts will likely be split 50-50 and "long-term" refers to 10 years and above, so whether you are in the house physically or not during divorce proceedings should not matter.

You might want to seek professional legal help to answer these questions and then discuss your options with your ex-spouse. If you are not living there, it doesn't make sense for you to pay utilities bills, but in divorce, it's better to be extra careful before you make any major moves.
