Hi I have a question. I am a step father, and I want to adopt my step daughter. Her mother and I are of course married for seven years. Her bio-father has agreed to sign over his rights. Here is the question, does he sign over his rights to my wife, and then I adopt. Or does he sign over his rights to me and I adopt all in one step? Also he lives in ca and I live in tx, where do I file, here or ca?

He would not sign his rights over to anyone, he just has them terminated.

You would need to see an attorney where you and the child live. As long as everyone is in agreement it might not be too expensive. Call around to a couple attorneys and see how much they charge for an uncontested termination rights and step parent adoption.
