If a parent is mentally abused by the father of her children and they are not married and he signed an affidavit stating he acknowledges he is the father of the children can she ask for his parental rights signed over.

She can ask all she wants; it won't happen until there is someone (adoptive dad) there to adopt the child.

Courts generally will not terminate the rights of a parent unless there is a subsequent adoption by a step parent.

Just because he is supposedly mentally abusive, does not mean he will be be a bad parent.

You can ask him, I doubt he will agree to this, and you can almost bet a court will not approve it anyways if you are not remarried.

Termination of rights needs to be in the childs best interest.

The other parent does not have to use his/her visitation if he/she chooses not to, but it is unlikely rights wil be legally terminated.
