Can you be legally bound by something you signed while under the influence of pain medication after major surgery?

Maybe ... it depends. Just what did you sign?

My daughter signed papers giving CPS permission to get her past mental health records as well as a paper called a "Safety Plan" in which the CPS worker claims my daughter made statements about hurting her baby. She was also "interviewed" by CPS and a detective (who was not identified to my daughter as a detective) while on these pain medications.

Your daughter can raise these issues at any court proceeding and challenge the validity of any signature or admission. However, unless she was clearly looped at the time of the conversations and signatures, it is questionable how much weight these claims will have.

The courts have regularly determined that signatures and agreements made by inebriated or high subjects are valid, so it will really come down to how obviously "out of it" she appeared to be at the time.
