We have a strong case, but I cant find an attorney. I dont have money to hire an attorney and the nature of the case does not seem attractive to attorneys that will work on contingency. Before I try to file by myself I am seeking some input.
In April 2007 My disabled daughter was injured at school. She is in a manal wheelchair and can not move it herself. She is nonverbal and communicates with gestures and a computer device that says whatever she types. LAUSD is required by law and written contract to provide an adult assistant for her all day at school. The school did not provide this assistant which created a situation that otherwise would not have existed that created tha opportunity for a student classified as emotionally disturbed to push her chair hard and let go. When this happened my daughter tryed to stop the out of control chair by putting her foot down. Her knee was severly dislocated and we had to go to the hospital by ambulance.
First, we have a written contract with the school that states that an assistant will be provided. We have over 16 letters written by me, my daughter, and other advocates, to LAUSD because they had been refusing to provide this assistance. I have a State CA Dept. of Ed. complaint corrective action, as well as LAUSD internal complaint corrective actions ordering the school to provide traind assistance, but they refused. When they refused I went all the way to the board of ed with it and was ignored.
Heres the part where I think attorneys are loosing intrest- the back story- January 2006 I made a complaint against an assistant principal. After that the AP and several employees went off the deep end with intense retaliation against both me and my daughter. That retaliation included the sudden stop of providing appropriate assistance consistantly. The more they retaliatted, the harder that me and my daughter fought for our rights- the more we stood up for our rights- the more they retaliated! I have evidence of fraud, forgery, breech of fiduciary duty, discrimination, harassment, attendance fraud and other acts that they did in retaliation.
ABSOLUTELY EVERYTHING CAN BE PROVEN I already battled LAUSD in due process to partially address the loss of educational benifit, I have investigation results confirming discrimination and other offenses, and the required CA Tort Claim has been filed (and not returned for insufficiency) It doesnt hurt LAUSD to wait and see if I file, and that is what I need to do!!!
