Assault & Battery Man beaten badly and then arrested for aggravated battery with a deadly weapon

My son was at a club in Florida one night with his wife, his sister in law and cousin. The sister in law and cousin were waiting in the car for him and his wife so they could leave. My son heard the tire from the car next to him hissing and the owner of the car said my son bumped the car and did that to his tire. My son told the guy he was a mechanic and could help him with his car. The guy told him he didn't need any help. The guy later found out a screw in his tire was the problem. My son's wife got angry with him because he was not leaving and walked off into the night. My son was not aware she had left, he thought she was in the car waiting for him. When he got into the car he found out she had left. Worried and frantic, he got into his car and started driving through the parking lot looking for her. She is bipolar and was not on her medication because she wanted to have a couple of drinks. It's 12:00 p.m. and she weighs 90 lbs. Making a right turn a guy jumped out in front of him and he almost hit the guy but swerved to the right to avoid hitting him. At the said time bricks came flying through the back window of his car, breaking the window. My son panicked and started driving like a bat out of hell to get out of there. When he got to the head of the parking lot, he thought about what happened and decided that he had to go back to check and make sure the guy was okay and also offer his insurance info because he didn't want to get arrested for leaving the scene of an accident. He went back and didn't see the guy so he inched forward and stopped his car to have his sister in law check the damage to the car and to search for his cell phone to call the cops. 4 people came to his car window and pulled him through the window of his car by the neck, they slammed his face into the gravel, then they dragged him about 15 feet from his car and beat him unmercifully. We later found out the guy he almost hit was an off duty police officer. He had his knee in my son's back and assisted to brutally beat my son. Every time my son picked his head up he would slam his face into the gravel. When the sherriff came and found out an off duty cop was involved they beat my son too and told him he deserved what he got. They never called for an ambulance for my son, they put him in the back of a police car and kept him there for 3 hours bleeding from lacerations above and below his eye and moving in and out of consciousness. He was later transported to the hospital trauma unit. He has 15% brain damage, a curvature of the spine, a broken nose where the hospital should have called in a specialist to reset the nose, now he has to have surgery to repair his nose and he will be in a body cast to repair the injury to his spine. To crown it, he was arrested and is facing 6 felony charges because all these people say he tried to run them over. His attorney has 4 witnesses who can testify that he was not trying to run anyone over nor did he hit anyone. We have paid the attorney $10000 and now he says if we go to trial we have to pay him another $5000. He also said that my son's injuries has nothing to do with the case and his pictures of his injuries may not even be allowed. The prosecutor has to prove intent and they cannot because that was not my son's intent. The attorney thinks my son should take a plea bargain because he doesn't want to take the chance of him being found guilty and sentenced to 10 to 12 years in prison by the sentencing guidelines. Two of the other witnesses never showed up for depositions and will not show up. Can this attorney have the charges for these witnesses dropped or can they use the two witnesses who do show up to try and win this case? Somehow I feel that my son's attorney is not working hard to get these bogus charges dismissed. I don't think a jury will find him guilty. He had no motive to hit anyone or try to hit anyone. It is dark at night and someone jumps into the street from behind a pine tree. He is the type of kid who will risk injury to himself to avoid running over a squirrel much less a human and especially since we had just buried his grandmother a week earlier. Please advise. Also can't he sue for excessive force and police brutality? My son could have died because they neglected to get him timely medical attention. The cop who was with him at the hospital signed a release to discharge him from the hospital, and my son refused to sign the release because the Doctor's thought he should be spending another night in the hospital. While he was in the hospital they had him in the ICU and his blood pressure sky rocketed to 126/126. The law says that you have a right to defend yourself if you are threatened but they frown on excessive force. If you folks are on the jury and hear this story, would you find this kid guilty of aggravated batter with a deadly weapon or would you deem it an accident that was blown out of proportion and these people did a modern day lynching on a kid weighing 110 lbs.
