A friend of mine was told that she has been sued in a small claim court (a TV show got her name from the court and contacted her). The problem is that she has not been served with any court papers and therefore is not aware of the lawsuit.
We think that a process server (for the plaintiff) has served or left the court papers to a different person thinking that it was my friend.
People told us that servers do not need to obtain signatures from defendants when delivering court papers. They just leave the papers where defendants live and certify that the papers have been delivered and served. The problem is that they can drop the papers off at wrong places.
My friend does not want to call the court to find out about the lawsuit because she believes that if somebody wants to sue her, they need to serve her properly. Is she right in saying that and what problems she may have for not contacting the court? Thanks.
