The District Attorney could still pursue charges. There is another victim out there besides the store... and that is the person who's SSN was used.

You will be extremely lucky to escape this mess unscathed.

Nope. It is still identity theft.

You describe a number of felonies - one or more of which could be potential federal charges.

Consult legal counsel ASAP.
 
You're not an offender until you've been convicted. You were wise to refuse to speak to the police. That doesn't mean you're in the clear, yet. But, it'll help later.

Get that lawyer. Keep mum about everything.

You also should remove the top post. You never know who might read it that you wouldn't want to see it.

Doesn't matter- you still used someone else's personal information to obtain the card. It doesn't matter at all that it was prepaid.
