I-9 Termination to Paid Administrative Leave

I have an employee who was notified in October that her I-9 had expired and she needed to present a new work authorization form. Her new form did not come through until the end of November. However, a few days before she received it, she was terminated. She was allowed to finish out the work day and leave when she completed any outstanding assignments.

Through the course of December, she presented her new forms with her old employer, went through the on-boarding process including a background check and drug test. In early January, she received confirmation that everything was complete and she could start back in her role the following week (confirmation sent in writing).

Less than a month later, she received a call from her manager that they had found something on her background check and she was being put on paid administrative leave effective immediately. At that point, the CEO's Chief of Staff was at her desk and escorted her from the building. While walking out, he stated that this was all their fault, they made a mistake in November and she was owed an apology.

She has a copy of her background check and no issues are indicated on it. She called the company that performed the check and they confirmed that nothing was identified on her check and that no further contact with the employer had occurred regarding the employee since the report's completion.

This employee has consistently been a high performer but I fully expect that she will be receiving a severance package shortly. What I don't understand is what could have occurred that would prompt such a reaction, especially escorting her immediately out of the building. That implies that her continued presence would create a greater risk for the company.

Any thoughts on where to look?
 
Yes, ask the woman, she knows what was discovered.
She committed the foul deed.
 
Based just on what is posted, I don't see where the employer did anything illegal.
