Recently my sister was charged with assaulting my nephew. He was taking into state custody. The caseworker for the case, informed my sister that the only way she could get him is if she stops doing drugs and go to classes. At this point my sister is still doing the drugs and refuses to get help. What rights do I have as his aunt? I truly do not want my nephew taking away from us. Please help!

You have no inherent legal rights as an aunt. Where is Dad?

His dad is not involved. My mother is the next option. However due to her health issue she is unable to take him.

You have no rights to the child. Your mother has no rights to the child.

You or she can certainly offer yourselves to CPS but I doubt that they will put the child in foster care with a family member. Too easy for the mother to have access to the child despite your protestations and insistance that she won't.
