After doing a probation search in my home, the Officer in charge of the search handed me a piece of paper that was titled "Evidence Report". It listed misc. items like 'unused sandwich bags, indicia, etc . . .', but it DID NOT have any illegal substances listed on it. However, when I went to court the next day, I was charged with possession of a controlled substance. This is the second time that this same Officer has raided my home. And both times I was handed an "Evidence Report" by him that DID NOT show anything illegal as being found. But charges were filed later in both cases. Charges of items that he claimed he found, but neglected to list on the "Evidence Reports". How can this be?!?

It could be that upon testing or more closely inspecting the items, the "indicia", they discovered the presence of a usable amount of whatever substance you are being charged with.

Your attorney can address the issue and any perception of inconsistency or wrongdoing.
