Custody Question

My niece's father died in 2009. Her mother remarried and moved to Minnesota. Mother had three other girls with her new husband. Mother just died in a car accident. My niece is living with her sisters, step-father and maternal uncle. If the step-father does not want custody of my niece, could the uncle get custody? Both my niece's grandmothers are willing to have custody but they live in California. Would that be possible?

First of all, my deepest, sincerest condolences upon your tragic loss.

What you've described is far too complicated to receive a proper answer on the 'net.

If the grandparents wish to obtain custody of the child, it's possible.
It'll be difficult, but possible.

Both women are logical, legal next if kin, by her father also being deceased.

The women should contact the child services agency in MN.
Both will need lawyers, too.
The agency sometimes can be compassionate and cooperative.
The women, or woman, needs to start this today.
The longer she waits, the harder it'll become.
