Custody of step child after divorce

My husband has decided that he wants a divorce- I have his 11 year old daughter living with me and out 5 year old daughter. We both feel that it is in the best interest of everyone for the girls to live with me. He has sole custudy of my step daughter, her mom still has some rights but visitation is all up to him..... how do I become her legal guardian after we are divorced?

You have no legal rights to this child at all. Actually the biological mother will get custody likely if the father does not want it.

Step-parents in most cases have no rights to custody. You need to see an attorney.

Mom is incarcerated, dad works on the road- only stays in each place unti a job is complete-usually 6 month at the most. I have an appointment with a lawyer next week.
