Hey guys, this should be a fairly easy one for you. I know this may be a grounds for dismissal, but I want to ask someone more qualified about what my defense in court should be. I live in New Jersey. Today I got pulled by an officer and received a ticket for allegedly having window tints. However, as the statute he listed 39:3-77, which is:
39:3-77 Unapproved Equipment or Devices

1. No person shall sell, offer or use any unapproved device or equipment for use on a motor vehicle.

And as the traffic offense/statute title, he listed:
Tinted Windows

"Tinted Windows" is not an actual law in new jersey, and im pretty sure 39:3-77 does not apply for tints. The proper statute in my opinion would most likely be:
39:3-75 Safety Glass

1. Vehicle shall not be driven with unduly fractured, discolored or deteriorated safety glass.

So I am wondering if this would be grounds for dismissal in court, and what my defense should be, other than "incorrect statute".

I await your response. Thanks!
