i am looking for advice on possibly filing a wrongfull death suit. My brother died the day after having oral surgery and was a healthy 24 year old young man. His only heath issue was that he was sever profound mentally retarted. He went into surgery to have four teeth pulled and he was under general anisthesa for 9 hours! The doctor released him from the hospital after only being in recovery for 45mins. The next day he stopped breathing and was taken to the ER after calling 911. He was immediatly put on several medications as well as life support. There were a team of about 5 doctors in and out with him and they told us that he had gone into cardiac arrest and they thought he had phenmonia, they said that they thought it came from the surgery (developed either during or shortly after). Later that night he died and when we recieved the autopsy report he did infact die of broncopnemonia. He had gotten a physical from his primary care physician and the doctor who would be preforming the surgery and he recieved a clean bill of heath one week prior. So should we be in grounds for filing a suit agianst the hospital or drs. who preformed the surgery? We are still trying to make sence of all this. Its just not right to go into surgery to have 4 teeth pulled and come out 9 hours later and die 24hrs. later when you are healthy... right??
