My wife was written up for talking about not being asked to stay late the day before, she was also suspended for a day. She tells me it was written up as gossiping. She was saying how it was rude she was not asked to stay late yesterday, when sh stayed late. That's it, they called it gosip and told her she is suspended for a day for gossip. Is this legal? To lose pay over it??is this not a hostile work environment when they threaten her write to freedom of speach?

Freedom of speech only applies to the government keeping it from happening, not to employers.

Yes, it is legal. No, it is not even remotely close to meeting the legal definition of an HER. And no, this is not a free speech issue.
