California resident, married less than 5 years, with no children and with little to no assets... we met the requirements to file for a summary dissolution!
We read the "SUMMARY DISSOLUTION INFORMATION " booklet (CA FL-810) and carefully followed ever instruction. Filed the "JOINT PETITION FOR SUMMARY DISSOLUTION OF MARRIAGE" form (CA FL-800). Received our case number from the court. Waited the 6 month period.
I filed the "REQUEST FOR JUDGMENT..." form (CA FL-820). As instructed, I submitted... three (3) copies of the form; each set of copies were stapled with 2 holes punched on top, and I included one (1) SASE addressed to the respondent and one (1) SASE addressed to the petitioner respondent.
BUT, the request for judgment form (CA FL-820) and the other SASE were returned to me --- NOT SIGNED BY THE JUDGE --- On the cover letter from the court, there was NO notation that the spouse had filed the revocation form (CA FL-830) and nothing was highlighted on the original request for judgment form to indicate any missing information! The ONLY notation was that the forms were missing information or incomplete!
After careful examination of the form I see two things that may be the reason the form was returned:
I did NOT put in "In Pro Per", where the space designates "ATTORNEY FOR (name)" Could that be the reason it was returned?!?!
I did NOT fill-in the two blank areas, under "CLERK'S CERTIFICATE OF MAILING", which state "HUSBAND'S ADDRESS" and "WIFE'S ADDRESS" because it appeared that was for the clerk to fill-in. Should I write our return addresses or leave that for the Clerk to fill-in?
Help --- Thank you!
