My car was recently damaged in a hit and run accident. At the time, the vehicle was parked outside my apartment building, and I was several thousand miles away in another state.
A truck apparently reversed quickly, hitting the car next to mine and pushing it into my car. The owner of the vehicle was found, and made a full confession to the police. He said that although the car legally belongs to him, he loaned it to a friend, and his friend was the one who hit the cars. The owner of the vehicle does not have insurance, and my insurance does not cover this accident. I want to bring the owner to small claims court to have them pay for the damages.
Who should I sue, the owner or the driver?
