Does the Whistleblower Protection Act apply to a Nebraska Public School?

The whistle was blown on the administrator who intentionally did not follow through with a board action, although reminded twice.

By not following the action, it was of benefit to another school where her husband is the administrator.

When the failure of complying with the board action was reported to the Board President by an employee, the adminstrator severely & unethically retaliated against this employee. The retaliation made the employee so sick, the employee had to resign under doctor's orders.

If the Whistleblower Protection Act does apply to this situation, would there be a basis for a civil lawsuit? What would be the statute of limitations? Would the statute of limitations extend to any length of time the employee is still suffering ill effects from the retaliation situation?
 
You would need to file a complaint of retaliation within 90 days of the act with the Department of Labor. http://www.dol.gov/ You may be able to file your own civil lawsuit but you need to have a lawyer assess your options and the burden of proof is a heavy one.
