Recently,

I was informed of a class action lawsuit against a company that I used to work for. I would have qualified as a valid candidate for the lawsuit had I been aware or the proceedings. Now that I found out after the conclusion of the lawsuit and the settlement has been closed, is there any chance that I would fall into the discovery/tolling category to pursue a claim now? If so, how much time to I have to act on this?

Thanks!

There is no way for us to know for sure - you need to talk to the lawyer who handled the case & see what he/she says.

Generally though, class action suits involve any person who hasn't "opted out".

If you've opted out, you'd still be able to file a private suit as long as it's timely.

If you didn't, you're still actually entitled to a portion of an award if you otherwise qualify.

For most people NOT opting out is the better option. But once in awhile opting out is the smartest thing you can do because you're not bound by the terms of the settlement and your potential award could be several zeroes more than what you'd get if you didn't opt out.

Then again, how old is the settlement?
