I have a problem. I am wanting to make a will to make sure my son goes to his godmother. But I know his father and grandmother will pursue this in court to get custody of him. If I leave my son to his godmother in a will, is there anything that they can do about it? I was never married to my son's father, nor does he have any parental rights to him as of now. He isn't even on the birth cert.! He has a shady past, and I don't feel like my mom did alot raising my brother and I, so I don't want her to get my son!

Please tell me if this is possible!

Thanks!

there is nothing preventing them from pursuing custody. Children cannot be willed. You can put your wishes into a will but whether or not they will be followed is a different story.

Paternity will have to be established by the Dad before having any rights. There is nothing stopping him from requesting a paternity test at any time. Godparents have no legal rights in most cases. They are of no legal relation to the child.
