K Visa Want to marry Canadian with a criminal record

I have noted the 3 things required to apply for a USA waiver. The only thing we are not sure of yet, is the 12 month sentencing max. The crimes he committed are not considered of moral turpitude, he served 4 months for one of them, just dont know about the max sentencing thing yet.
However, what if I went ahead and got married to him in Canada. Would the USA make an exception for marriage if it turns out the crimes were for the max of 12 months?
How does the USA handle marriages like this?

It looks like your mixing two legal concepts, aggravated felonies and CIMT's. They are two very different things.

1. What crimes did he commit?

2. Please specify the dates of the crimes.

3. Is he currently on probation?

4. Does he currently owe any fines, probation fees, or any other debts related to his sentencing?

5. Is there currently any warrant out for his arrest?
