W2 and final paycheck are being withheld for no reason

W2 and final check were to have been mailed 1 week ago. We have not received them nor will the employer return my calls. Is there legal action that can be taken against this company?

No. Why not go to the employers office and request duplicate copies?
W2's were not legally required to be mailed until the end of the month. Perhaps yours is due in the mail in the next day or so.
