I am seeking advice on how to proceed with a voluntary termination of parental rights to a child. Both the mother and I have agreed to terminate my rights to a child she wishes to raise. We do not know each other well and she wishes to raise the child with her family. We live in different areas and agreed it would be in the best interest of the child to terminate my rights. My question would be how should I go about this process and would a court appearance be required, even though we both agree on the desired outcome? Thanks

Unless there is going to be a subsequent step-parent adoption, most of the time the courts will not do it. It makes no sense to terminate your rigths and leave the child without a legal father. If you did not want responsibility for the child you should not have gotten her pregnant. Now if she agrees not to file for child support or government assistance and you wish not to have any involvement, that is your choice but she can change her mind at any time and file for child support. Paternity will need to be established first if it hasnt already.

is this your child?

was paternity ever established? if not, you dont have rights to terminate, because you dont have a child. if so, there usually needs to be as stepparent willing to adopt before that can happen
