Just a quick question here. After a voluntary repo, I understand we are still liable for the deficiency.
The question is: if you cannot pay off the deficiency and are sued for it, does it become a criminal case with warrants for your arrest and all?

Thanks

Normally not, if you are sued by the creditor, that is a civil case. In the United States being unable to repay a loan is not a crime and cannot be criminally punished.

That said, there might be circumstances surrounding a loan and default, which might lead to criminal charges, such as fraud, embezzlement etc. But your run of the mill default is a civil matter only.
