Visual Contracts? Popular but Unbinding?

All around the internet, especially on dating and personals sites I encounter either this or similar messages. As someone who has read the ToS/ToU/EULA on many sites I don't believe this can be legally binding because on most sites "anything you post that has not already been trademarked or copywritten automatically becomes the property of <insert website here>." So is the following really legally binding, or just a bunch of popular nonsense?:

"WARNING: Any institutions or individuals using this site or any of its associated sites for studies or projects - You do NOT have my permission to use any of my profile or pictures in any form or forum both current and future. If you have or do, it will be considered a serious violation of my privacy and will be subject to legal ramifications. It is recommended that other members post a similar notice to this."
 
Go ahead, post whatever the site allows. That said, they'll own that post, too.

I suggest you investigate just how expensive it would be to pursue such a lawsuit.

By the way, it's been done many times. Each time, the plaintiff lost.
