My Ex and I have a 1 year old son. We finalized our court order in June 2008. Since then my Ex had come to me to move back in (said she was getting kicked out of her parents home). We had an argument and she claims I had intercepted her 911 call and assaulted her. She filed charges. Now I am forced to plea guilty on the domestic violence in order for the authorities to drop the felony because somehow she had placed that 911 and made them believe I interrupted it. The plea included to let the judge decide what the punishment would be. No plea agreement was signed. Now the prosecuting atty is saying I had agreed to jail time. Not true. My atty is requesting the court transcripts and we appear back in court next week. The judge (once he found out that I never laid my hands on her) sent me to the probation office to get an evaluation. I am worried that if I do have to go to jail would my Ex be able to take me to family court and ask that my visitation be eliminated?
