I have a situation that I need some legal advise on. My ex and I have joint legal custody. She lives with her boyfriend and has residential custody of my boys. I have 3 boys. We do not have an amicable situation at all..
This past weekend I had to take half the day off and go get my kids because my ex-wife needed to go to the hospital. Her water broke and she was going to be going into labor. We have a shared driving clause in our decree however I wouldn't throw that at her in this situation. So, I drove in the snow storm and took me two hours. Sorry if I am giving too much information. She was suppose to have them on Easter this year but she was still in the hospital. She ended up having twins and having a C-section. So, I have had to arrange my work schedule and get family to offer a hand to help my ex and myself out in this situation. Plus I am able to see my boys more which is a plus.
She is still in the hospital and will be until sometime tomorrow. Being that she has not been able to meet me for the exchange and is still in the hospital what are my rights as the joint custodian? I have to make arrangements to have my family watch them again tomorrow because I don't know when she will be home. But today she has threatened to call the cops on me for kidnapping if I don't bring them back to them by 3 on Wednesday.
I am a working father and can't afford to take anymore time off. And my parents do not have the capability to take them all the way up to them tomorrow. I will be getting off at around 3-4 and then my regular visitation starts at 5:30 tomorrow until 8. There is shared driving on those days as well.
I would not have had a problem taking them up there after my visitation time however she hung up on me before I could suggest that. There reasoning is that I have had them for longer than I was suppose too. And so I don't get my regular visitation time from what her boyfriend tells me. Most everything was relayed through the boyfriend and not my ex. So, today I called and left a msg stating that I need to speak to her in regards to the situation. She called and just said have them back at 3 tomorrow otherwise she will call the cops and then hung up.
Not sure what I should do or how I should approach this situation. Any help would be appreciated.
