verbal child visitation laws in virginia for unmarried parents

if an unmarried couple, living apart have a child together in virginia... they have a verbal agreement on the visitation of their son. its not in writing and they havent been to court. Can the father at any point see his son (if notifing the mother first)??? Is there any sites that answer that question. Hypothecially speaking... say the father gets to see his son on tuesdays until wed morning... and then every other weekend. could he pick him up after school whenever he wants to spend a couple hours with him and then drop him off with his mother when she gets home from work??? is there any sites that state laws to unmarried couples that only have a verbal visitation agreement?? please help
 
Is the father the LEGAL father? That is, did he sign the acknowledgment of paternity? If so, then he has the same rights to see the child as the mother. The verbal agreement is not a binding document.

In order to avoid confusion and confrontation regarding who gets what time with the child, you should go to court to establish custody/visitation.

If the father is not the legal father, then he has no rights to the child until paternity is established and he files for visitation/custody.
