could you please tell me what constitutes verbal assault especially in regards to a minor under 12 being the victim?

I don't know that any state has a "verbal assault" statute. Perhaps if you advised what state you are in and what was said to the child? There may be other applicable statutes.

However, if you spoke to the police and they said nothing can be done, then no such statute likely exists. or, the offending party was too young to be prosecuted for the offense.

People do not have a legal right to be free from offensive language - much as some of us might wish such was the case.
