Consumer Law, Warranties Verbal agreement not being honored.

I completed a verbal contract for services in April for $3,800.00. I received $500.00 on site and recently another $500.00 in check form that has been return NSF. I have not submitted a paper invoice, only verbal, email and text communication for money owed that gets responses of "the check is in the mail", I operate a DBA that performs services as rendered in April but this verbal agreement was between individuals. Do I have a leg to stand on to get the payment for services? Do I start with a invoice showing the original amount, amount paid and then balance? Since this was a "cash" deal do I leave it as that or send the invoice from the company? There are others in New York that have not been paid by this individual in Florida, some in amounts of $15,000.00 and more. They also have only verbal agreements, are they in the same boat as me?
