Put a down payment of $200 on a 2001 Subaru outback on April 1, 2016. I paid the seller, from Craigslist in person, $1600 Cash on April 6, the Outback had a refurbished engine put in by the seller ... He owns his own garage. I went to DMV, presented the Bill of Sale, PO Title and had everything done - no hiccups. The car was delivered to me on April 13, two weeks after the initial down payment, however he did not have the car inspected. He said he couldn't get it inspected because the car was in LIMP mode and that it needed to be driven, and he said he had replaced the solenoid to the transmission. Long story short, 1 week later still couldn't get the inspection car was throwing a tranny code and air intake code. Took the car to 3 separate garages and still couldn't get it inspected. Finally took the car to a transmission specialist - there was a laundry list of issues. I contacted the seller told him what was going on and asked to just have my money back he refused, this was all within the 30 days of having the car. He told me that the car was over 10 years old and that the vehicle was sold as is, unless I wanted to bring the car back to him (2 hour drive away) and he would fix it. I told him that the body was over 10 years old but not the engine and he still refused, more or less giving me the finger, I think an implied warranty is in effect and he is not honoring it by making the issue right. I told him I couldn't take anymore time off of work or school and he took that as a refusal. I had investigated his name and Business online and he was kicked off of Ebay for being a "bad" seller because he was a "take the money and run" and jilted someone else out of a transmission back in 2012/2013, which was on a webpage complaint. I then started looking at all the documents he gave me showing the engine was a refurbished Impreza engine and when I cam across the original bill of sale the signature was not his. I saw him write the Bill of Sale out and sign it, but didn't bother to look truly at it .... He had signed someone else's name, I imagine the previous owner and I can only think he did the same for the title.
I then took the car back to the transmission specialist and ended up having to pay $621 for a Solenoid which they said he never replaced and they fixed my hemorrhaging Power Steering pump as well. I also had to rent a vehicle for $287 for the week the Subaru was being fixed. I have tried to have it inspected now for three weeks and there is one module that will not clear, The EVAP catalyst and I don't understand why.
I seriously want to file a small claims against him and contact the DMV. I did receive my title with no issues. He did jump title, the PO would have had to been him and the Bill of Sale would have had to have his name on it and not someone else's name, so I wager that there are a few illegal issues he is doing through his business and he wants a dealer's license. I thought that you could not sell more than 2 cars per year in the state of NY, unless you have a dealer's license.
Someone please help me make my decision.
