I have a non-judicial foreclosure in my State of Arizona. There is NO case number in State Court.
I want to dismiss this foreclosure because the lender has failed to state a claim upon which relief can be granted.
If I send this dispute to the trustee, I'm sure they will send me anything but what I requested. I think the best way to go is through Court than disputing with the Trustee directly. But what area of the court?
I understand judicial foreclosure motions in other states goes with circuit courts. Arizona don't have circuit courts.
So I'm lost.
Is that OK to go to State Court and File a complaint (as there is no open case)? or keep disputing with the trustee (they will send me anythign but my requirements)?
