Consumer Fraud Used car deposit cashed after seller backed out and agreed to return c

Put deposit down on used car but seller called us within 1 hour to back out. 20-year-old college student selling car; agreed to price; left deposit. She texted me to apologize that her parents would not let her sell it at that price, and said she would return the check. We said that was fine and agreed she would return the check. The next day she no longer responded to messages and subsequently cashed the check. Can we file charges with DA? We should have put stop payment on check but we thought she was honest.

If I were you, I'd start by reporting the matter to the police.

See what they advise, civil or criminal.

Then I'd act accordingly.

You really don't know if she was a college student, ha d acar to sell, maybe she wasn't even a she, so theer are issues with this.

Again, another reason you don't buy anything from someone unknown to you.
