I need any help that you can give me. My husband had kicked my 18 month daugther and i out and said that he no longer wants to be married anymore...about three weeks ago. i had to go over there three days after the incident and noticed insurance papers on the table for him and my daughter...even though the whole time we were married he refused to get insurance. i have been letting him see her when he wants and have been doing everything his way. i am worried about the people that he has around her with no proof but they have and are always in trouble with the law and are very irrisponsible. im worried that him and his mom are going to try and take my daughter away because of the things they have been doing, and he has his best friend who is going through the same thing but is trying to take away the baby from his mom. now i am living with my mom because i cannot financially pay for rent because i only make 10 dollars an hour and my mom does not charge me for rent. they are having to move pretty soon and it looks as though i am having to move with them because i cant do rent and child care on top of all that and my car.....would i have to consult my husband about it first? please help i dont know what elsse to do

You would be best to not move too far away. It really all depends on the distance. You can certainly file for divorce and ask for custody. Legal aid might be able to help you. You can ask for child support, temp. alimony, and half of child care costs. Depending on how much money your husband makes, it is possible you might be able to petition the courts for him to pay your legal fees.

You are going to have to be able to provide for this child though if you want custody.

It would be best to find as good employment as possible as divorce is going to be a financial harship.
