Recently my sister got custody of her (4) children. Her husband who lives in a different County had custody since Feb 2009. When my sister arrived at her husbands house the children were there by themselves their dad left the day before for Phoenix (not surprised) my 5 year old neice said, "auntie my head hurts when I was living with dad"..I asked her why?? her dad talks nasty to her every night she was forced to sleep in her dads room with him while the other children where asleep in the next room. she said her dad puts some kind of oil all over her body and mouth...it makes me sick just to write this....my niece says so many vivid things a 5 year old wouldn't say. We took her to the Hospital for a check-up and we filed a police report . The Police officer informed us that we had to call the police department and County where it took place. The problem is they lived on the (Navajo Reservation) the children are (not Indian) Navajo police can not do anything about it either. This little girl is so scared of her father..(she won't open up to anyone but me) when she hears the door bell she runs and hide under my bed, please help me on how to proceed. (he works for the fire department)
What court granted mom custody? Mom needs to file for supervised visits only. Under normal circumstances I would call CPS but since Dad does not have custody I am not sure what they would do but their number is 800-SOS-CHILD. I'm confused on why Navajo police will not do anything. The kids are not indian so they should not be under ICWA. How did mom get custody in the first place?
It definitely sounds like Dad is doing something disturbing. I would even call the police in hger current city and ask to speak to someone in the child crimes unit to see if they have any advice or know anyone in Navajo couunty.
Please note that the regular channels may not be open to this OP - Tribal Law may well be what needs to be considered here.
If the children were on the reservation at the time, Navajo police SHOULD be able to act upon a report - if OP can list either the county or reservation in question I should be able to find contact information and perhaps further resources.
mom had Custody first but (cps) took them away to dad because of a drug problem..but she has been clean for a couple of months now. And the children were not happy with thier dad, so the judge question the the 2 oldes girls and they told the judge that thier dad was a crazy man.so he gave full Custody to mom for now.
The mother has full custody of the children. The judge did hand over the custody to her. Yes CPS was informed and they questioned my neice, but they refuse to hear from her two older sisters. My 5 yr old neice is not talking to CPS and they dont beleive her. Any advice thank you so much!!
