Unpaid Employer Taxes?

After reviewing the differences between an employee and independent contractor with the Department of Labor, IRS, and multiple other resources, I now realize I was an employee (even though the original contract provided to me by my "employer" stated I was an independent contractor)! I worked anywhere from 30-60 hours per week in his office, using his equipment and supplies, under his guidelines, got paid an hourly rate, was compensated for mileage and supplies expenses, etc. Sounds like an employee to me :yes:. Can I sue for my employer's portion of unpaid Medicare, social security, unemployment tax, etc. that I have already paid on his behalf?
