My husband has a child with another woman and he does not want anything to do with the child and the mother does not want him to have any rights. She does not want child support either, but the state got involved and they are trying to get him to pay child support. Is there any type of paperwork that can be drawn up so he will give up his rights and say that she does not want the child support and they go their separate ways? PLEASE help!!
 
Nope. He must support this child. You have nothing to do with this so should stay out of it. Mom went on government assistance so the state will make him pay child support. If he did not want to support the child or have anything to do with it he should not have gotten her pregnant. She cannot waive child support now that she has asked tax payers to support the child and unmless she is remarried and there is a subsequent adoption, he cannot just walk away from his responsibilities. I suggest he file for visitation.
 
Thank you for your thoughts, but I am not asking for your opinion or what you think. I am asking for legal advice. Everyone involved believes this would be in the best interest for the child. And for your information I am involved because this involves my family as well.
 
That was not opinion. It's fact.
He can't just walk away from his responsibility. She got money from the gov't, who is wanting Dad to pay it back to them. Can you imagine if everyone had that option? Half our kids would have only one parent and the country would go broke supporting them.
He doesn't have to exercise his right to access to his child, but the obligations don't go away.
 
My response is far from "opinion". It is not in the childs best interest to terminate rights and it is rarely done with a single mom. Why should taxpayers then support the child? If your husband chooses not to see the child that is fine, but he must support the child. It is common that the state goes after your husband now since mom went on government assistance.
