I have an 8 yr old girl that is living with her father in Tennessee. I would not accept joint custody with this man because he was very manipulative and controling and always found ways to make it look as if I was not mothering my daughter. This man has done some terrible things to me, like drugging me and taking very disturbing sexally explicit pictures of me without me ever knowing. The only way I ever found this out is during the divorce he started mailing these pics to people I knew. He was telling people I was a sex freak and I made him do these things. Not having any trust in the law and knowing his narcistic ways I knew that anything that I would do would be twisted just as he has now done. He uses me as his excuse to why he is not making it financially (which he never has) and why he can not have any relationships with women. He is 48 yrs old and takes baths with my daughter. She spends almost every night at friends houses or her Grandmothers until about 9:30pm then he gets her and she is usually up until 11pm. I have been having him watched by detectives so I know these things. There are people in the house at all hours coming and going. He is having sex (trying to) in the living room with different women and my daughter is sleeping in the master bedroom which is right next to the living room. Some nights he puts a video in the tv and he will sit in the living room masturbating. He has a male friend that comes over they will sit in the living room masturbating together. There is so many odd things going on this house. When we were married he would masturbate over me when I slept. But he denied it and so no one seemed to care about what he did to me. He has involved himself with the chuch so that he looks like this great, spiritual father. I have been divorced for a year and we were separated a year so it has been two years since I lived there. I moved to Georgia almost 6 months ago and now I want to know if I can get my daughter going through the courts in Georgia? I did have a parenting plan in place where I had a visitation like schedule and we were joint on all decisions. When I moved here last May we agreed upon a summer schedule where I took her for three weeks then he took her for three weeks. Now that she is in school I traveled there a couple of weeks ago and spent a long weekend with her and now I will get her for holidays. So I am telling you this so you know that I did not leave town and stop seeing my daughter.
I want to see if I can go through the courts here for custody since I am now living here. If I can produce evidence of the above things can they be used to help me or will it be considered illegal. My daughter can not be raised in this house or environment. I feel it is only a matter of time before she sees something or he is doing things to her. If I went and got her without permission from the courts what could happen to me? I want so badly to go and get my daughter and bring her here but I do not want to ruin being able to keep her going forward. Please help me save my daughter from something terrrible.
