We are developing an online forum for business owner to pitch their ideas to potential investors named TheSharkTank.com Would this be a trademark infringement? SONY Trademark: Word Mark: Shark Tank
Goods and Services: Entertainment services in the nature of an ongoing reality television serious, involving presentation of business concepts.
 
Good question. There are no guarantees in trademark until there is a ruling although there are variables which one can make best "guestimates." It's arguable that there may be an extension into the online world and the similarity of the business may very well cause a likelihood of confusion in the minds of consumers. Regardless of whether this is the case, you should get representation immediately. From my experience you will receive a cease and desist letter from Sony, regardless of whether the law may come out on your side that there would not be trademark infringement. The TV show is too open and notorious and there are too many dollars invested in the brand to think that Sony will let this go unchallenged. What you may want to do is register for the mark (there may be some strategies involved) and see what happens. But with something like this you definitely need to speak to a lawyer given the players and the issue. If you need help, let us know in the support section.
