total loss, no insurance, hit and run.

my sister was involved in a hit and run and seriously injured. The other driver hasn't been found. She had no automotive or health insurance having been layed off for almost a year. The vehicle is a total loss.

The vehicle is not paid off but under my father's name, because my sister could not get credit. She was paying my father back in small amounts.

Do we contact the finance company and inform them of the total loss and the fact that the vehicle did not have insurance? Since the account was under my father's name what risk to his credit/legal status would this since his daughter was driving his vehicle withouit insurance? Albeit he was not aware of this until now?
