Would it be too much to ask that you actually take out your policy and read the Better Car Replacement coverage?
Whose insurance? Yours or the other guy's?
How long ago did you pay $23K for the car? Cars depreciate rapidly, you know.
The insurance company will tell you the value of your car based on its own research. If you don't agree with the assessment, you can dispute by doing your own research into the 3 price guides (NADA, Edmunds, Kelley Blue Book) and the local for sale ads.
If you are disputing the value with the other driver's insurance company you will have to sue the driver and prove the value in court.
If you are disputing the value with your own insurance company you can invoke the Appraisal provision of your insurance policy.
It looks something like this:
APPRAISAL
A. If we and you do not agree on the amount of
loss, either may demand an appraisal of the
loss. In this event, each party will select a
competent and impartial appraiser. The two
appraisers will select an umpire. The
appraisers will state separately the actual cash
value and the amount of loss. If they fail to
agree, they will submit their differences to the
umpire. A decision agreed to by any two will be
binding. Each party will:
1. Pay its chosen appraiser; and
2. Bear the expenses of the appraisal and
umpire equally.
B. We do not waive any of our rights under this
policy by agreeing to an appraisal.
You'll have to read your policy to find it.
