My ex-boyfriend filed for custody in Kentucky last year and nothing has been done in this case. At the time my daughter and I were on Ohio Medicaid and Ohio required me to file for Child Support. So I filed for Child Support around the same time he was filing for custody to gain some visitation rights. I always have had and still have an open door policy with visitation. When we went in for the first and only custody hearing in November, my ex, his lawyer and me and my lawyer (that has abandoned the case) wrote a visitation agreement. We were never in front of the judge and the case has been at a standstill. He is no longer pushing to complete the custody he has petitioned for, yet does have the established visitation he was after. I would like to officially file for custody of our daughter where I live in Ohio, but cannot with the case still pending in Kentucky, where her father is from. Does anyone has any advice for what I can do being pro se in the case to get it out of Kentucky so I can file here in Ohio?
Filing for taxes is coming soon and my ex wants to claim her this year. So I am also wondering who is legally and rightfully the one to claim my daughter this year? He does not "work", he is a full-time student and admits to working "under the table". After leaving school and the welfare system to work a full-time job since March of this year, I now pay for medical insurance covering my daughter and have an okay income being a single mom. I'm not sure if it's relevant but I have a judgment awarded from a suite I filed for money he borrowed from me when we were together. He has not been making any attempts to pay this money back to me, nor support her while she is here.
Really I am not out to take money from this guy or make his life any harder. I just want what is right and best for our daughter. I think she deserves to have two hard-working parents. It is not easy being a single parent whether male or female!
Any advice would be appreciated! Even if you are in the same position would be supportive. Thanks!
