My father passed away earlier this month. The only property he owned with a title is an antique car that's currently in pieces. The estate would be insolvent if I were to file for probate. He appears to have under $5k in debt and a little over $1400 in his bank account. I paid for his cremation out of my own pocket. Is probate necessary?
I realize the car doesn't fall under the exempt property, but it just seems silly to spend the money on a lawyer when it won't benefit my brother and myself at all.
What happens if we don't file? will that car title ever be able to be transferred?
