Timeshare Spcial Maintenance Fee

My husband and I have a timeshare at Divi Little Bay in St. Martin. I
listed the State/Country as Non U.S., however, Divi Resorts is a North
Carolina based company.

They have hit all the owner with a special maintance fee on top of the
maintenance fee. It is to cover beyond the renovation of our unit, but also
their conversion of the hotel into more timeshares.

I have read thru my contract several times. Although it clearly state the
maintenance fee and it\'s appropriate increase, it does not mention anything
regarding their right to charge such a fee.

What, if any, are my rights in this situation.

Netherland Antilles ( Sint Maartin).

Here is the statement about the maintenance fees on our contract:

"I/We understand that the annual maintenance fee for the about unit is presently $ per year, payable on an annual basis and due six(6) months prior to the contracted week, regardless of whether or not I/we make use of the week. This fee may be adjusted in accordance with reasonable increases or decreases in expenses and or services."

They want to basically charge us TWICE the normal maintenance fee for the next two years. For example, our maintenance fee for this year is 660.00, the Special Maintenance fee is 654. The end result would be 1308 in special maintenance fees over two years.

Have you questioned the amount? and if so what did they say? Try and get every corrispondance in writing so you know exactly the text they are using.
