How long after the death do I have to file a petition with the court for a probate hearing?

You first need to go to the probate court and file to be the personal representative of the estate. Take a copy of the original death certificate. This should be done within thirty days.

doesn't this depend on whether the person had a will or not? Cause I was told from Maine Probate Court that you have 3 years if there was a will and there is no time limit if there was not will.
