We sold a restaurant with the agreement that we would not open another one within 5 miles. We found a new location that is 6.2 miles away. But we are now informed that the 5 miles is meant to be the way the crow flies. There is no way to get from the old to the new under 6 driving miles. Do we have any rights here.
