tempory order for holiday schedule

Hi, my ex-wife filed for a motion to amend our custody agreement for our son who is 13. This agreement was set fourth in Jan. 07. At that time I was awarded primary physical custody with both of us having joint custody. We were first supposed to go to trial for this back in Aug. but she didn't turn in her answer to the discoveries so my lawyer had it cont. So thats how we ended up with a court date of today.

Then yesterday night I got a phone call from my lawyers secertary saying that her(my lawyer) child is sick with the H1N1 and that the trail was going to be cont. again. She also told me that my lawyer said that I did not have to be present today but that my ex-wifes lawyer is motioning for a emger. hearing date because my ex wanted to change the thanksgiving and christmas holiday schedule since the lawyers couldn't get a date on the books for the trail before Thanksgiving. So I asked what did my ex want changed and that I will be willing to work with her on this so that we won't hopefully have to do a hearing. Well long story short we couldn't come to a agreement for the holiday schedule. I just thought I was going to get a date and time for the new trail and then one for the hearing.

I then just got a phone call from my lawyers secertary saying that the judge ruled in my ex-wifes favor and ruled a tempory motion to amend the holiday visitation schedule at the trail hearing. I thought that the only thing that could happen today was the judge would give a new trail date and schedule a emger. hearing. Since I wasn't there nor was my lawyer is this legal to do with out me having any repersation? And if so is there some way that I can appeal this ruling since it is a tempory order and not a final order? I asked the secertary this and of course she doesn't know and said I will have to wait to talk to my lawyer tomorrow but I feel like something should be done today.

Talk to your attorney. Getting free advice when you are being represented is not good. If you doubt him/her when you talk to them then come back and ask our opinion.
